1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “User,” or “you”) and AtlasCore AI (“Company,” “we,” “our,” or “us”).
By accessing or using any AtlasCore AI website, software, automation system, or communication service (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree, do not access or use the Services.

2. Scope of Services

AtlasCore AI provides AI-driven business automation, messaging, and marketing solutions.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter a binding contract.
Use of the Services is void where prohibited by law.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Notify AtlasCore AI immediately of any unauthorized use or security breach.

5. Acceptable Use

You agree not to:

Use the Services for unlawful, fraudulent, or abusive purposes.

Send unsolicited or unauthorized advertising, spam, or bulk messages.

Interfere with network integrity or security.

Reverse engineer or attempt to extract source code from any software provided by AtlasCore AI.

Violation of this section may result in suspension or termination of access without notice.

6. Fees and Payments

If any Services are offered on a paid basis, you agree to pay all applicable fees using the payment method provided.
Payments are processed securely through third-party processors such as Stripe.
All fees are non-refundable unless otherwise required by law.

7. Intellectual Property

All content, trademarks, and technology within the Services remain the exclusive property of AtlasCore AI and its licensors.
You receive no ownership rights by using the Services.
Limited use is granted solely for lawful purposes in connection with the Services.

8. SMS Messaging and A2P Compliance

By providing your phone number, you consent to receive SMS/MMS messages from AtlasCore AI for notifications, confirmations, and marketing related to your relationship with us.

Message frequency varies; message & data rates may apply.
AtlasCore AI complies with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and A2P 10DLC requirements.

9. Third-Party Integrations

The Services may integrate with third-party platforms such as OpenAI, Go High Level, Google Analytics, Meta, and Stripe.
Your use of these integrations is subject to each provider’s terms and privacy policy.
AtlasCore AI is not responsible for third-party performance or content.

10. Confidentiality and Data Protection

Both parties shall protect confidential information exchanged under these Terms.
AtlasCore AI will handle personal data in accordance with its Privacy Policy.

11. Disclaimers

The Services are provided “as is” and “as available.”
AtlasCore AI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, AtlasCore AI and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages arising from or related to the use of the Services.
In no event shall total liability exceed the amount paid by you to AtlasCore AI for Services in the twelve (12) months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless AtlasCore AI, its officers, employees, contractors, and affiliates from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.

14. Termination

AtlasCore AI may suspend or terminate your access at any time, with or without cause.
Upon termination, all rights granted to you shall cease immediately.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
You agree to exclusive jurisdiction in the state and federal courts located in Santa Clara County, California, USA.

16. Changes to Terms

AtlasCore AI may update these Terms at any time.
Changes are effective upon posting the revised Terms with an updated “Last Updated” date.
Continued use of the Services constitutes acceptance of the revised Terms.
